A deed is a legal document that grants its holder ownership of a piece of real estate or other assets. In most cases, the deed is a transfer from one or multiple individuals to another individual or set of individuals.
Deed transfers can look different in terms of a variety of different circumstances. In some cases, deeds are used to transfer a house or property within a family. For example, a deed transfer would be used in the case that an individual is moving into a nursing home and would like to transfer their house to a child or grandchild. When an individual that jointly owned a house with their spouse passes away, a deed is used to transfer the house from the couple to the individual’s name. And when an executor is settling an estate, a deed transfer is used in accordance with the deceased individual’s wishes.
A deed can also be used to alter how property is shared between multiple parties. The most common way this is done is by altering a deed to a Tenancy-in-Common estate. This means that rather than the whole property passing to the other owning party or parties upon one’s death (also known as the Right of Survivorship), the share of the property that was owned by the deceased individual is instead split up as they intended in their Will.
